Read more about the CCUS State Legislative Tracker, maintained by the Arnold & Porter Environmental Practice Group

This tracker provides an up-to-date survey of the legislative frameworks that states have enacted to facilitate Carbon Capture Utilization and Sequestration (CCUS) projects. The map layers above can be selected to view at-a-glance which states have promulgated which types of provisions or undertaken certain other significant state actions to facilitate CCUS development. Individual states can then be selected to access a brief summary of the relevant provisions, with links to the statutory text or other source documents. This tracker primarily focuses on provisions relating to carbon sequestration, but some of these state laws may also address certain forms of carbon utilization. This survey is intended to identify trends and facilitate comparison between state CCUS legal frameworks, but not to provide legal advice or interpretation of the law in any state.
