Summary/Abstract
On October 8, 2024, Brazil enacted Federal Law No. 14,993/2024, stemming from Bill No. 528/2020, the “Fuels of the Future Bill.” This law regulates activities related to carbon capture and storage (CCS) and marks Brazil’s first legal framework for CCS. It mandates that the National Agency of Petroleum, Gas, and Biofuels (ANP) oversee CCS operations, including authorizing carbon capture, transport, and geological storage, with permits valid for 30 years and renewable.
The law distinguishes between CCS and carbon injection for hydrocarbon recovery, requiring separate authorizations. CCS operators must meet obligations such as managing emergencies, maintaining validated records of CO2 storage, and inventorying carbon storage and leakage for carbon credit certification.
This law provides regulatory clarity for CCS development in Brazil and may lead to new regulations from environmental agencies under Brazil’s National Environmental System (SISNAMA).
