Summary/Abstract

This report addresses the legal and regulatory challenges associated with the adoption of commercial scale carbon capture and storage projects in Canada. Under the heading of property issues, the report discusses three issues: ownership of pore space, the need for a Crown disposition system, and surface rights. Under the heading of regulatory issues, the report discusses how a storage project would be deal with under the current Canadian regulatory framework, the Canadian government’s role in geological sequestration projects, and the implications of listing CO2 as a toxic substance under the Canadian Environmental Protection Act.
