Summary/Abstract

This article addresses the issue of pore space ownership under both U.S. state and federal law. The article identifies how recent case law and legislation follows the prevailing, majority rule that the surface owner owns the rights to the pore space, and is therefore entitled to compensation for use of the pore space.
