Summary/Abstract

This report provides a high-level regulatory overview of the legal issues of importance for a combined Enhanced Oil Recovery (EOR) and Carbon Capture and Storage (CCS) project in Denmark. Such a project proposes injection of captured CO2 from, for instance, power plants or industrial installations in Denmark or another European Union (EU) Member State into selected oil reservoirs in the Danish North Sea, for the purpose of simultaneously increasing the volume of oil produced and permanently storing the injected CO2. In this manner, the project will combine EOR with CCS.

The aim of the report is to assess the CCS and EU Emissions Trading System (ETS) regulations applicable to a combined EOR and CCS project, as well as to review other applicable regulations in Denmark, including EU regulations and international conventions and agreements to which Denmark is a party. The scope of this report does not include a review of applicable tax, financing and state aid laws, or transportation laws (with respect to the transportation of CO2 by ship).
